May 20, 2010 – High Court clarifies right of counsel to appear in District Court

In his written judgment in the case of Heinullian v The Governor of Cloverhill Prison, Mr Justice Hedigan has held that barristers do not have to be attended in the District Court and have a right of audience in the District Court by virtue of their call to the bar by the Chief Justice of Ireland. Prior to Mr Justice Hedigan's judgment, there had been some uncertainty concerning the right of counsel to appear in the District Court where instructed but not attended by a solicitor.
